1. Scope of application
For all deliveries of Explore International Limited to consumers, these General Terms and Conditions (GTC) apply.

3. Offers and conclusion of contract
3.1 The presentation of products in the online shop is not a legally binding offer but an invitation to order. All offers are "while stocks last", if not stated otherwise on the products. Errors excepted.
3.2 The presentation of products in the on-line shop is not a legally binding offer, but a non-committal online catalogue. By clicking the button "Send Order" you place a binding order for the items in the cart. The confirmation of your order takes place together with the acceptance of the order immediately after sending by automated email. With this email confirmation the purchase contract has been concluded.
4. Contract text
The contract text is stored on our internal systems. The General Terms and Conditions can be referenced at any time on this page. The order information is sent to you via email. The acknowledgement of the order is expressly made before ordering. After completing the order, the contract text is no longer accessible over the Internet for security reasons.
5. Withdrawal
Consumers have a statutory right of withdrawal.

You can cancel your contract within one month in writing (e.g. letter, fax, email) without giving reasons or - if the goods have been received by you before the deadline expires - by returning the goods. The period begins upon receipt of these instructions in text form, but not before receipt of goods by the recipient (both recurring deliveries of similar goods, not before receiving the first partial delivery) and also not before we not fulfill our information obligations. Consequences of withdrawal
In the event of an effective cancellation the mutually received benefits are returned and, if the case, any benefits used (e.g. interest). You cannot guarantee the service received and used (e.g. advantages) or partially or only in deteriorated condition, you have to pay us compensation. For the deterioration and the goods and the derived benefits, you must pay compensation in so far as the benefits or the deterioration is due to handling of the goods, beyond inspection of the characteristics and functionality. By " inspection of the characteristics and functionality " means the testing and trying out of the goods, as it is possible and common in a shop. Transportable items are to be returned at our risk. You have to bear the cost of returning the goods if the delivered goods ordered corresponds to the price of the products which not does not exceed an amount of 40 Dollar or if at a higher price of the item at the time of the cancellation have not rendered a counter service or have provided contractually agreed partial payment. Otherwise, the return is free of charge for you. Items which are not deliverable by post are picked up. Obligations to refund payments must be fulfilled within 30 days. The period begins for you with the dispatch of your cancellation or item and for us with its receipt.

6. Price and shipping
6.1 The prices listed on the product pages include VAT and other price components.
6.2 The shipping costs depend on the amount of goods ordered and the type of shipping and you will be clearly informed before submitting your binding order. You can find an overview on the page Shipping.
6.3 Cost paying agreement If you exercise your right to cancel, you have to bear the cost of returning the goods if the delivered goods ordered correspond and if the price returned does not exceed an amount of 40 Dollar or at a higher price for the item at the time of cancellation if it has not yet been paid or a contractually agreed partial payment has been made. Otherwise, the return is free for you.
7. Delivery
7.1 Delivery is normally only within Europe. For delivery to other countries an additional cost is incurred.
7.2 The delivery time is normally three to five working days within United Staates. Variations in delivery times are pointed out on the product page. Delivery to other countries depends on the receiving country and cannot be predicted by us.
8. Payment
8.1 You may pay either with PayPal or creditcard.
8.2 A right to set-off is available only if your claims are established in court or are undisputed or acknowledged by us in writing.
8.3 You can only exercise a right of retention if the claims result from the same contractual relationship.
9. Retention of title
The goods remain our property until full payment.
10. Warranty
The warranty is subject to legal regulations.
11. Applicable law
11.1 The law of the United Staates of America applies.
11.2 The provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.
11.3 The contract is concluded exclusively in the USA.
